Auction Terms and Conditions

Terms & Conditions:

    1. This auction is a charitable action run by Home Grown Hotels Limited incorporated and registered in England and Wales with company number 07659273 whose registered office is at Clayhill, Beechen Lane, Lyndhurst SO43 7DD.
    2. All proceeds will be split equally between Action Against Hunger (registered charity number 10475011) and Hospitality Action (registered charity number 1101083).
    3. This auction is open to UK residents (excluding Northern Ireland) aged 18 or over. Employees of Home Grown Hotels Limited and its promotional partners are not permitted to enter the auction.
    4. In order to participate in this auction you must hold an account as a registered user of the online auction platform operated by Air Auctioneer Pty Ltd (Air Auctioneer). All bids must be placed through this platform.
    5. Bidding will be open for each lot from 11am on Friday 1 September and close at 12pm on Friday 8 September (BST). We reserve the right to change the start and end time for bidding on any lot. Any change will be notified to you on the individual page for each lot.
    6. The starting price for bidding is as indicated on each lot.
    7. By submitting a bid you shall be deemed to have read and agree to be bound by these terms and conditions, the Air Auctioneer user agreement, and the additional terms and conditions referenced below.

    We act as agent for the seller of this lot. The lot will be fulfilled by the company specified in the lot description. The contract for sale is between you and the seller, and the supplier's terms and conditions.

    1. When you place a bid it constitutes a binding and irrevocable offer which may not be withdrawn other than as specified in the Air Auctioneer user agreement.
    2. The winning bidder is the person certified by Air Auctioneer to have made the highest bid on the close of the auction for the relevant lot (Successful Bidder). The decision of Air Auctioneer as to the winning bid shall be final and cannot be challenged. You will be contacted by us if you are a Successful Bidder.
    3. Upon the close of the auction, the Successful Bidder enters into a binding contract to purchase the items for the amount of their bid. No additional delivery costs will be payable. Title in a purchased lot will not pass until we have received the full purchase price in cleared funds.
    4. Payment must be made by credit or debit card within 48 hours of the auction closing via our payment provider Stripe Inc.
    5. It shall be the responsibility of the Successful Bidder to come to an agreement with us or the company we have partnered with to provide the lot (as applicable) over the arrangements for the fulfilment of that lot, including the dates upon which such lot is to be made available.
    6. Lots will lapse, and not be claimable, unless they have been fully taken by midday on 7 September 2024.
    7. Notwithstanding that a Successful Bidder has been declared, in the event that: (i) we discover that the Successful Bidder was ineligible; (ii) we are unable to contact the Successful Bidder; (iii) full payment in cleared funds is not received within 7 days of the auction closing; or (iv) the bid is otherwise deemed invalid for any reason, we in our absolute discretion reserve the right to reject the bid and offer the item to the next highest bidder (as certified by Air Auctioneer) who will then become the Successful Bidder. These terms and conditions shall continue to apply to such Successful Bidder.
    8. Lots are non-transferable, cannot be exchanged, have no cash value, and are not for re-sale.
    9. Unless otherwise specified in the description of each lot, travel, food, beverages, accommodation and other incidental expenses are not included in any lot and shall be at the expense of the Successful Bidder.
    10. We reserve the right to cancel the auction, withdraw a lot from the auction, disable a lot so that bidding is suspended, or substitute a lot with an alternative item whether prior to, during, or following the auction if in our absolute discretion we deem it necessary due to events or circumstances outside of our control. We are under no obligation to provide a reason for our decision. Any such changes will be notified to you on the individual page for each lot.
    11. To the extent permitted by law, HGH does not accept any liability for any loss, damage, claim, costs or expenses howsoever arising from or in connection with: (i) your participation in the auction or the fulfilment of any lot; or (ii) any act or omission of Air Auctioneer including, without limitation, the availability of the online auction platform, cancellation of your account, or our removal from the online auction platform.
    12. We will collect and process your personal data and it will be shared with Air Auctioneer and the companies we have partnered with to provide lots for auction (as applicable) to the extent necessary to conduct the auction and to fulfil each lot.     13. We reserve the right to amend these terms and conditions.  Any amendments will be published on the individual page for each lot.
    14. This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be subject to the jurisdiction of the courts of England and Wales, and shall be governed by and construed in accordance with the law of England and Wales.
